Hi.  I believe HIPAA does indeed apply to most venues.  Social Security may 
be exempt although I don't think so.  If so, they are covered under another, 
closely-related, law.  But all mental health / social services through the 
state and private sector are covered under HIPAA as are health services. 
I'm not up on Federal.
I am very sure that Federal is covered under some privacy act as HIPAA is, 
actually, a Federal privacy act so I"m sure there is an equivalent.
I can indeed tell you all its a very good thing to start learning for 
yourselves if you do not know what you, specifically, are obligated to do 
because if you find yourself face-to-face with a client who has filed a 
complaint, you've waited an hour too long.
Anyway, that's my last word here because I'm not your legal advisor.

Um; maybe I'm really dense here, but we received a lot of HIPA training 
when I lived in GA--maybe a little overkill--while Florida didn't seem all 
that concerned, and I do have to discuss health-related matters with my 
consumers, as they may impose some barriers to independence/employment 
whatever, so I thought the law applied more broadly than you seem to be 
saying here.

Keep in mind that HIPAA only applies to health related information and to 
healthcare facilities.  It does not apply to settings like the welfare or 
Social Security office, but there is other privacy legislation that may 
apply in those situations.

Darla, I suspect it didn’t happen before a client brought it up was for the 
simple reason that it never occurred to the powers that be that this would 
be an issue. We’re probably going to see a lot of these issues coming up as 
time goes in in this Dilbert-driven cubicle society. I had occasion to visit 
the Social Security office not too long ago, and while my business was being 
dealt with I could hear, plain as day, what was happening in cubicles 
nearby. To me, this was more than a little unsettling. At some point these 
issues are going to have to be dealt with on a large scale.
